Legal Question in Criminal Law in Colorado
Can I get my charges dropped?
On the night on 8/31/08 My husband after drinking too much on too little sleep started to become beligerent to a party of people we had in our home. He asked everyone to leave including myself and my children. We were trying to gather up belongings when he began yelling at me, having seen this my son yelled back and a shoving match began between him and my 16 year old son. I believed that it was going to become worse and I ended up punching him in the eye for him to release my son. I have never been in trouble before and I was really just protecting my child. What are my chances of speaking with the DA and this charge being dropped? I would like to do it as to not have my husband look evil either since this really was not his character on this particular evening, he has no record either.

Re: Can I get my charges dropped?
You can't have it both ways. Your claim of self-defense sounds credible, but if the DA believes you, he or she then must believe you were protecting your son from an aggressive father. The DA may or may not decide to drop the charges against you and instead press a charge against your husband.
Good luck.
