Legal Question in Criminal Law in Colorado
Child Abuse?
I recently got a ''child abuse'' ticket for leaving my set of 18mo old twins in the car for approx under 5 min unattended. (3 wits said under 2 min). I went in to the vet clinic and picked up my dog after getting shots. Litterally the woman at the counter ran my credit card and I walked out. How severe could this charge potentially be? Both babies were asleep, and the car was left running. (For the AC to be on.) I was within ear shot the ENTIRE time. Any help would be huge thanks!

Re: Child Abuse?
Yeah, they charge that. Child abuse includes putting a child at risk for harm. I agree this is over-charged.
I have worked on a similar case where we got a very favorable deal - no record and minimal consequences.
Who called the police?
Just because it is charged, does not mean that you are guilty. DAs and police started charging this when a baby died a few years ago. But, you are no where near that situation.
Re: Child Abuse?
The worst you are likely to suffer is a fine. But I think you're asking the wrong question. How severe a consequence might you have suffered if a car thief, who just waits for a person to leave his or her car running unattended, had taken your car, with your babies inside it?
Consider this a wake-up call.
Re: Child Abuse?
Depending on how you are charged, as a misd. or felony, this could or could not be serious. There are all types of consequences with child abuse charges, as there is a state child abuse list and can impact such things as employment, licensing and who you can be with. Because of these affects, I would consider fighting this. Good luck.
