Legal Question in Criminal Law in Colorado
Colorado habitual criminal stututes
Once the DA files an ''habitual'', does the cas go directly to trial? Is a plea bargin still posible? How does this affect sentencing? Does the judge still have discretion or are mandatory sentencing guidelines superceding?

Re: Colorado habitual criminal stututes
Plea bargains are possible until the judge or jury comes in with a verdict. Judges must abide by the statute, which calls for a multiple of three or four times the maximum of the presumptive range of the sentence.
