Legal Question in Criminal Law in Colorado
in colorado ho far can the prosecution go in an asualt charge if teh victom does not want to cooperate? Also child abuse charges just because children were in home but were not harmed at all?

The government can go all the way to a guilty verdict at trial, even if the alleged victim will not cooperate. Practically and practicably, the government will be saddled with a "not guilty" verdict at trial if the alleged victim will not cooperate. That is why the government agents will offer an attractive plea bargain deal in the hopes that the defendant will take it and admit to guilt without a trial. Child abuse charges will also be added. That way, the offered plea bargain will be even more attractive to the defendant. Do not enter a plea of "guilty" until you have spoken to an attorney.
