Legal Question in Criminal Law in Colorado

criminal conviction

My question is, i was recently convicted of petty theft. first time offender with no criminal history. I have been placed on a years unsupervised probation, paid fines, have to take a class and perform public service. at the end of a year, i will withdraw my guilty plea and the conviction will be dropped. my question is, when will this show up on a background check & how long then does it take to remove after a years time?

Re: criminal conviction

It will show up now and, if what you describe is a deferred sentence, and you successfully complete it, you can petition the district court to seal the record. The process takes a couple of months.

Re: criminal conviction

If it was a deferred, it should show up now, but it will change and show as "dismissed" after you comply with the deferred requirements and one year passes from that date of plea. Then, you petition to seal. Seal takes 6-12 weeks... and it won't even show up as "dismissed" There will be no record of conviction, plea or deferred, once seal pet. is granted.
