Legal Question in Criminal Law in Colorado

2 persons are arrested on a misdemeanor charge in Boulder colo. in 1970 and this year,2008, person '1' discovers (while trying to expunge, or seal, that record) that his friend ,person '2', has recently had a 'record check' in a job interview and finds the arrest IS NOT on his record. Does this have any effect on helping 'person #1's ability to challenge ''his' record in his efforts to find a way to expunge, or seal, his own record?..these were a non violent petty theft charge (stole food)

Check your own record at cocourts.com (maybe you're not there either). Petty offenses usually don't show up in employment checks and hey, almost 40 years ago? Who the hell will care?
