deferred judgement and nursing

I plead no contest to a DV case where I was also a victim and had a deferred judgement and was told by the court and victim advocate that I must take the DV classes and after that was completed then my case would be sealed. I am now entering a profession where I will need licensing from the state and went to the City where I was arrested and was told that they do not have me on record for any arrests or convictions. Nothing has ever showed up on my background checks but what is on record with the state?

Sealing is not automatic with a deferred, although it sounds like it is sealed. To questions about a sealed record, the state must reply that it has "no such record" and you can put on applications that you were never arrested (if this was the only arrest you had, unless the others are also sealed. As to your question about state licensing, the record is not really gone and some state agencies can break the "seal" and find out what is behind it. dan www.lawyerdan.com
