The offense could, theoretically, get you prison time. The biggest factors are the weight of the quantity seized and prior convictions. "they got me with a QP, I'm on parole for PCS II w/intent." -That will mean harsher punishment than "Police seized two Zs and I have only a prior PO of possesion under a Z". The options open to you expand if you have counsel.

it can, usually depends on the quantity, the number of times, and the prior record of the person.

also, if it is near a school or other special areas.

also, if the person has a deadly weapon near the drug - the farther away the deadly weapon, the better

remember, giving away less than 1 oz of MJ is not distribution - free means that nothing is given in return (not even sex)
