eavesdropping
if I am talking on a phone and someone else overhears part of the conversation from my end and thinks I said something racist or defamatory and sues me, can I sue them for eavesdropping?

Not unless they were illegally within ear's reach, such as that you made your comments in your home and they were in your home without your knowledge or permission, or the knowledge or permission of someone else who lives or was invited there.
