Exploitation of children

My son was arrested in CO.after the FBI tipped off the local police.They had a search warrant and arrested him and took his 2 computers.

What would his jail sentence likely be for being in possession of internet child pornography?

It is impossible to say exaclty what the sentence he is looking at would be without seeing the exact charges. Colorado is one of the worst places in the nation to get charged with any offense involving an allegation of sexual misconduct. For many felony sexual offenses, Colorado has what is known as "indeterminate sentencing". What that means is that a person can be sentenced for a term of probation or prison for up to the remainder of their life. Now that may well not apply to your son, but that gives you an idea of the kind of laws which govern his case. Whatever he does, he needs representation, and he needs to make certain not to talk to anyone about his case. Not police, not cellmates, not on the telephone.

Your son needs to say nothing to the police and hire an attorney immediately. Colorado has some of the most draconian sentencing laws on this stuff. The Feds may be involved too.

I would be pleased to help.

All phone calls from jails are recorded, so he cannot talk to anyone but an attorney without risking the statement coming into court against him. Many jails will record visits between inmates and visitors.

If he is charged and convicted of sexual exploitation of a child, the crime that fits your description, he faces a year to 18 months in prison.

It is absolutely time to hire an attorney.

Without looking at the charging documents and knowing if he is being charged in federal or state court, it is impossible to know what length of jail sentence your son would be facing. What is important is immediately getting him an attorney that has defended these cases and knows what they are doing in either federal or state court. Good luck.
