Fake ID (Forgery)

My son (20 years) is on probation (4 years) for possession of drugs(first time offender) He has served about one year of probabation. He recently was caught using a fake ID to purchase alcohol. He has a hearing next week. What is the likely penalty and what kind of attorney should we contact

It is hard to tell what the likely penalty without looking at the file for the first case, but depending on the case, it can range from being placed back on probation to incarceration, with options in between. You need a criminal defense attorney like myself to 1) defend against the new charges and 2) find out his exposure in the old case. Good luck.

Review of the original probation order will yield conditions/terms and suspended penalties. The NVL OTTI term will be violated by conviction in the new case. You have got to deal with them both at the same time. Also, you need a criminal defense attorney. Best would be an attorney in whatever county wherein his violation and alleged violation are brought.

Violation of probation can result in a revocation of that probation. That means your son may be ordered to serve the sentence that was suspended upon his probation.

You need a criminal defense attorney.
