Fake ID/MIP/Supplying to minors

Some friends and I recently were

ticketed for minors in possession of

alcohol. When asked by the officer

how it was obtained I told him that I

bought it at a liquor store. I have a

fake id and have used it there

several times, however, had not

actually been carded during the

purchase of the alcohol that night.

Furthermore the ticket is written

solely for the MIP and the fake id

wasn't found or cited on the ticket.

For one, would it be

wise to consult a lawyer, and

secondly what type of charges would

one assume this case will have?

You can assume you will be charged for what is written on the ticket, in this case minor in possession (MIP). Depending on the jurisdiction (Boulder, for example), you may be offered a diversion if this is your first MIP (you take a class and stay out of the criminal justice system), or a deferred sentence if your second (stay out of trouble and complete classes and community service and pay fines, and the charge will ultimately be dismissed).

If you have already been convicted of one MIP, you may be offered probation. If you have already been convicted of two MIPs, you will be charged with a misdemeanor, which carries possible jail time.
