false statement

my wife gave a police officer a statement that she had been rapeed.

She is on 17 different medications that distorts her thinking. can she be charged with anything. we are talking to the investigator that the statenaent was not true but dillusional. can she be charged with any serious charges?

If she named her delusional attacker, and that is a real person, and that information has traveled beyond the police report, she could be sued for defamation.

It is possible, but I think unlikely, that the police will press a charge of false reporting, assuming you can document your wife's mental health dilemma.

If a real person was named, I think you have a responsibility to apologize and do everything you can to disabuse people of the notion that this man harmed your wife.

Hard to say, the cops have the option to pass their report on to the DA and they have the option to charge or not. Good luck.
