Legal Question in Criminal Law in Colorado

Felony burglery, B & E, and Property Damage

I would like to know the possibilities, on these charges. My friend is 18 yrs of age, has no prior adult offenses, and don't remember anything due to the fact of intoxication. What is he looking at?

felony burg can be an F3 or F4, with a range of probation up to 12 years plus 5 years of parole. Unless restitution is very high, or there are other aggravating factors, the chance of probation is very good. Intoxication is likely not a defense.

Get a lawyer and work towards no felony.

Sounds like pink elephants. But he's also looking at a possibility of years in jail. What he should be looking at is hiring a lawyer, or if he can't afford it because he's indigent, a public defender.

His intoxication may be used to negate the element of intent required for a burglar conviction. That means he must have intended to commit a crime inside the place at the time he broke in.
