Legal Question in Criminal Law in Colorado

Help with Felony

I had gotten a deferred felony and I thought it would be over. i did all what i needed to do and that was it. I recently applied for a job and their background check came up showing the deferred felony was still active? I don't understand this. Everything is done. Is it possible to get my record sealed? I don't even know where to start. I had this all done in Pueblo CO

Re: Help with Felony

Either the court (or you) failed to dismiss the case upon completion of the deferred, or you were charged with & pleaded to another another offense while the deferred was still working. File motion to correct the record. That is first. Then you petition to seal.

The felony charge is not still active; if you completed your deferred the charge was dismissed. The record of the charge, however, is still very much active.

You need to petition the district court to seal the record. You or your attorney should contact the court clerk to take steps to do that.

Good luck.
