Legal Question in Criminal Law in Colorado

helping friend

in early february, my friend was arrested for resisting arrest, and minor possesion. She says police were looking for someone else when she was apprehended. The police at the event we were attending were looking for someone in a hat that was smoking , a hat more resembling my own. Her lawyer says that after so long if I confess that I was the one in the hat I couldnt get in an trouble. And the only reason I would consider this is that her sentence would be reduced. What should I do?

Your friend's lawyer is getting paid to look after your friend's interests, not yours. If the police were looking for you in connection with a criminal matter that you were involved with, or that they even think you were involved with, of course you can still get into trouble.

It is unethical for the attorney to suggest that you cannot, if I understand you correctly. Just as you and your friend could not possibly have been wearing the same hat at the same time, her attorney can't wear two hats and represent your friend and you at the same time.

If your dilemma is that somehow your friend got charged for a crime you committed, whether you should confess is a moral question, not a legal one.
