Hi,

I have a question about a voluntary manslaughter case. Two men are having a conversation over drinks which suddenly turns violent when the first man (we'll call him Dave) tells the second man (Jim) that he's in love with Jim's wife. Jim punches Dave, causing Dave to hit his head on the floor. Dave is in a coma for several months before he finally dies six months after the incident. Prior to this incident, Jim has never committed a crime. Based on these circumstances, how many years (approximately) could Jim expect to be imprisoned? Thanks!

In the State of Colorado, Manslaughter is a class 4 felony. A class 4 felony has a presumptive penalty range of 2-6 years in prison, and can be 1-12 years depending on mitigating or aggravating circumstances. However, that does not mean that Jim will be doing an prison time as probation is not out of the question. You should advise your friend to talk to a criminal defense attorney.
