Legal Question in Criminal Law in Colorado
I'm hoping you can help me understand the best route for my situation. I was charged with misdemeanor theft for a $30 shirt. The whole ordeal was an honest mistake. To make a long story short.... I took my newborn out shopping. while in the fitting room, he began to cry and scream. Frazzled and tense, I started taking out everything in his diaper bag, throwing his blankets and extra clothes onto the bench, looking for his pacifier. After I got him calmed down and back to sleep, I just started grabbing handfuls of his stuff and quickly shoved it in into the bag so I could get out of the store before another crying fit. Apparently, I grabbed a shirt as well and put it in the diaper bag without realizing it. The people at the store had already called the police before speaking with me and I was issued a summons. What should I do here? Should I plead guilty or not guilty? Is it possible that the judge will just take it off my record during the summons after hearing what happened? I really want to avoid trials and lingering court appearances, because it is so stressful. But I don't want this on my record for a misunderstanding!! How can I get this off my record?
