Legal Question in Criminal Law in Colorado
my husband was arrested 6/9/16 in Denver Colorado for 2nd degree assault her is not charged by the victim in this case with the assault he is only involved because the man that did assault the victim mentioned my husbands name as an accomplice. They were car pool partners to work. my husband did get out of the car when the victim attempted to stab the man assaulting him with a screwdriver. My husband has never been in trouble in colorado before, he did go to a preliminary court or something to set bail although he was not aloud to speak or anything as the judge said at that time he was only on an investigative hold and not been offically charged. the public defender was extremely late and the judge was extremely unhappy, his bail was set so high I could not get him released. once he has a second court date will he get a plea or possibly released as the orginal charges were not brought up with him?
1 Answer from Attorneys
He might be released if the prosecutor decides not to charge him, but don't count on it. It is unlikely that he would be in custody if the prosecutor wasn't pretty sure charges would be filed.
Your husband's attorney can ask for a reduction of the bond at the next hearing. He needs to work with his lawyer.
