Legal Question in Criminal Law in Colorado
If an individual stole an item (i.e. bike) from a fenced backyard, and there is a dog house and a dog present, can this individual be charged with burglary?

The fenced backyard is not a building. It will be theft based on value and criminal trespass. Burglary must be unlawful entry or stay into a building or dwelling.
