Legal Question in Criminal Law in Colorado

interference with police

My son was arrested last night for interference with police. He was leaving a friends, with 2 others when police pulled up and instructed him (kid in white shirt) to stop, cuffed him and asked him why he was running from them. (he had just exited apt. where he had been all evening. ) When they checked his id...they found out he is participating in drug court, a deferment program, immediately took him in, was never informed of what he was charged with, etc. Bail of $500 was posted...found out he was charged with interference...He will plead not guilty....what is the level of this charge, and does he need an atorney?

Re: interference with police

This is most likely a misdomeaner charge, but without looking at the charging document, I cannot say for sure. He definately needs an attorney, as he is potentially facing a jail sentence and a permenant criminal record. Good luck

Re: interference with police

Take a look at his ticket. If he was charged with 18-8-104, which is a Colorado statute, that means he was cited for obstructing a peace officer. That's a class 2 misdemeanor, which may carry a penalty of three to 12 months in jail, a $150 to $1000 fine, or both.

Offhand, I think an attorney isn't too wild a choice.

Good luck.
