Legal Question in Criminal Law in Colorado
Juvenile crimes
My 14 yr old son was charged with resisting arrest while caught shoplifting. They charged him with assault, are they the same thing? What should we be looking at as far as doing any time for this crime.

Re: Juvenile crimes
Resisting arrest, shoplifting and assault are not all the same. They each require different elements to prove. As for penalties, it depends on where the juvenile is charged. In municipal courts there is little chance of incarceration. In state court, there is a chance of detention.
Re: Juvenile crimes
Assault and resisting are two seperate crimes. The punishment for your child depends on his criminal history. It can range from probation to out of home placement to incarceration, depending on the circumstances of the crime and his past.
