Legal Question in Criminal Law in Colorado

kidnapping, DV assault,

3 yrs ago my friend was in an argument with his wife he picked her up and took her around the building. She pressed charges and then did not follow through instead followed him to 2 states. Now that he has filed for divorce she is going to press charges and they have extradited him from florida to colorado. will these charges stick after this many years and will they see she is being vindictive due to filing for divorce? He has been arrested since this and Colorado did not extradite and now it has become a nationwide warrant and they have extradited him

What happens with your friend really depends on what the prosecutor decides to do with this case. If they see this fr what it is, they may end up dismissing or plea bargaining it away. Or they may go to trial, it is hard to know what the final result will be at this time without more information. But, it is ultimately the DA's decision on how they proceed. Good luck.

they can file it - the statute of limitations should be long enough - the evidence of why she is pursuing and all that is evidence to show she is making this up (if not admitted by client), and will make plea bargaining better, but if she is willing, DAs usually are too - have him get a good attorney or Public Defender - this will cost some money
