kidnapping?

is it kidnapping or could someone get into any trouble by tieing someone up, taking them for a ride and letting them walk home as a gag or to teach them a lesson?

It may be a gag to you but it may not be so to the person who experiences the acts you inquire about.

It could posssibly be kidnapping but more facts are required.

See CRS 18-3-301 through 18-3-303.

Please be advised that even if your facts do not fit within these specified statutes it may fit within others resulting in possible criminal prosecution and / or even liable for civil damages.

It may not be advisable to play such gags and if you do you may expose yourself to possibly very serious charges and / or consequences.

Playing gags may become very very expensive.

second or third degree assault, kidnapping, false imprisonment. The possible charges are great, depending on how the cops/dda's handle it. The there is the civil/money issue.

That particular bit of wholesome, good-natured fun is more likely to wind up teaching the kidnapper the lesson, ranging anywhere from a punch in the nose to a charge of first degree murder, in the event that during the course of the gag anyone, even accidentally, causes the death of your prisoner.

If you're the victim, consider calling the police.

If you're the happy-go-lucky fella planning this prank, consider suing your parents, and cut way back on the Jackass viewing.
