Legal Question in Criminal Law in Colorado

In 2001 I was charged with harrassment and told by the DA once I completed all there requirements the charge would no longer appear on my record but I have lost my job because it appears on a background check. Is there any way to get the charge off my record like I was promised?

You must petition to have the record sealed. There is information on how to do this on the Colorado Supreme Court website. I am willing to do this for $1500.

You can only seal acquittals, dismissals or completed deferred sentences. IF there is a conviction of any kind on the case, then you cannot seal it.

If what you did was successfully to complete a deferred sentence, the charge would still appear on your record, and there would be a notation that the case was dismissed.

But to completely hide the record from an employment background check, you would need to petition the district court, in a civil action, to seal the record.

You can do that now. Call the clerk of your district court.

If it is a deferred that was sucessfully completed, you can likely seal it. File in District Court. The filing fee charged by the court is +/- $130. You can do it yourself, what the statute you need to follow is confusing, so most hire an attorney.
