Legal Question in Criminal Law in Colorado
Limitation on gag orders
If a person is charged with a criminal offense can the judge put a gag order on the victim but allow the suspect to defend themselves in the press? In other words the victims name and information cannot be released to the press even if the victim wants it released.

Re: Limitation on gag orders
I know of no limitations on gag orders. The court can make any number of orders. I do not think any court would make such an order over the alleged victim's request. Typically, gag orders are done to preserve the entire process and therefore cover the entire process, both sides. But in a criminal case, the court does not have any jurisdiction over the victim and therefore has some trouble punishing a violation of an order by the victim.
