Legal Question in Criminal Law in Colorado
marijuana
If a police officer saw person A give person B an amount of marijuana under an ounce and person B gave person C ''x'' amount of money, what would likely happen? Would any legal course of action be taken? That wouldn't technically be distribution right?

This is distribution, any transfer of drugs, whether for money or not, is distribution.

well, it does not have to be distribution, but it would probably be charged that way - it seems like those facts get the case to trial and jury - whether the jury convicts is another story - the jury would have to believe it was possible that the money was for something else and the MJ was an unassociated gift - better make sure everyone is on the same page before you risk that one

Wrong; everybody gets arrested, unless the cop looks the other way.
