Legal Question in Criminal Law in Colorado

Marijuana posession

I received a ticket for possession of less than one ounce of marijuana and possessions of paraphernalia. This my first offense. MY record was COMPLETELY clean before this. What will likely be my punishment?

Re: Marijuana posession

Depending on the county you are charged in, most likely you will receive a plea bargain offer that will eventually allow you to clear your record, such a a deferred sentence. This is a contact where you plea guilty to a charge, but no conviction goes on your record. If you keep your nose clean and stay out of trouble for the time period (usually 6 months), then at the end of that time period, the case is dismissed and you can then ask that the records be sealed. God luck.

Re: Marijuana posession

The prosecutor will likely dismiss the drug possession charge if you plead to possession of paraphernalia. You should also, unless you feel you are wrongly charged (or proof is lacking), negotiate for a deferred sentence on the paraphernalia charge, meaning if you meet the conditions of the deferred, at the end of the 6-12 month period of the deferred, your case will be dismissed, and no conviction enter.

Good luck.
