Legal Question in Criminal Law in Colorado
Misdeamenor Offences
Can I be arrested because of 3rd degree assault on an EMT if I refused medical treatment to begin with? I had a ride waiting for me and wanted to leave and would not cooperate because I was mad and wanted to go home. i was forced to go in the ambulance against my will and apparently kicked the guy in the hand and he pressed charges against me.

Re: Misdeamenor Offences
You can be arrested and charged just like you have been. The question is really whether they had any right to do what they were doing. There is possible self defense. A case like yours can often be defended and won, but it depends on all the circumstances. Call me if you want to discuss it more or send an email.
