Legal Question in Criminal Law in Colorado

misdemeanor record

I have 2 misdemeanor arrests in Colo. in 1969 that are on my record but not with MY name attached to them ...can I challenge them for removal, and if so where do I start. I must add that 'get a lawyer' is not the answer because I have absolutely zero means of being able to buy that.

Re: misdemeanor record

Go to the Colorado State Judicial Branch website, go to the self-help area, and in turn the sealing records area, and download the info and forms. Read it all very carefully. If you're eligible to seal the arrests fill everything out very carefully. If you get a hearing be very certain that the arresting agencies and the DAs involved do not intend to object to the sealing. If you win your hearing, beg a court clerk to give you a list of every agency you need to tell about your win. Be very careful to serve these agencies correctly. Do all this, or you will have absolutely no chance of successfully sealing the records.

Good luck.

Re: misdemeanor record

The previous email thoroughly covers how you can seal the record without an attorney. I would add that, prior to sealing, you motion the court division to CORRECT its RECORD. If the arrests are not for your name, the record should be fixed.
