Legal Question in Criminal Law in Colorado
Nephew Arrested for F3 & F4, Sister on SSD - DA talking 48 to 64 years!
Short and to the point.
Nephew in custody for F3 & F4 (child abuse, and 2nd degree asslt).
No evidence for abuse charge, questioned even after asking for attorney. He just turned 17, was 16 at time of incident.
Mother (my sister) is on SSD and has very little $ saved, but no attorney will even consider unless she can do $500+ pymts/mo.
Judge's record shows favor of DA and max sentence.
PD has been ineffective in all areas & keeps trying to get him to plea guilty. Stated he is innocent.
We cannot seem to find any legal help for him. DA wants max everything!
Any suggestions or help would really be great!
I believe him having been around him all his life, he is not the monster they depict him as.
Please help us in saving him from prison.

This case may be ripe for a motion to suppress evidence obtained through questioning defendant after he made a request for counsel. The PD's position that nephew plead guilty may be based on whether PD can prove "not guilty" and how many years defendant will get under the deal versus at trial. You all can work with the PD if you try. Remember, a private attorney will cost you $~20,000. If you want to go with a private attorney, you'll have to sell your cars, sell your houses, pawn tv's, watches, jewelry, etc.
