Legal Question in Criminal Law in Colorado

Last night my brother was arrested for a warrent that was suppose to be taken out the system by the aurora pd. while he was in custody his bestfriend took his car to go meet the bailsbondman and he was pulled over in my brothers truck with a register gun in the car (not knowing) . well his bestfriend was on his 2 strike and with this now gun found in the car makes it his 3rd stike . is there anything we can do

If he did not know the gun was in the vehicle, it makes it defensible. Tough, but defensible.

Agree with Mr. Cassens. Get an attorney. Say nothing to the police or DA without one. There is also an affirmative defense for having a gun in a car. But talk to an attorney ASAP.

You need to get a good attorney, this is defensible case, as they have to prove beyond a reasonable doubt he knew the gun was in the car. He also needs to keep his mouth shut. Good luck.
