Legal Question in Criminal Law in Colorado
How do I obtain complete sheriff's report? - assault
I was recently arrested and charged with harrassment & assault of a woman during a traffic altercation (I'm male). I was the one who was harrassed and provoked into hitting this maniac woman after she tailgated me for over 5 miles (probably past her intended turn off) tried to run me off the road and then slammed on her brakes in front of me (my dog flew into the dash both times). When I got out of my car she tried to run me over, then stopped and tried to hit me with her truck door before I made any offensive move. I have a completely clean criminal record. I think she wanted me to assault her so she could ''go after'' me for $$$. I drive a nice car - she was driving an old pick-up truck. The sheriff who wrote the report won't return my calls or email and the DA's office hasn't responded to my call inquiry on how to obtain a copy of the complete report including her statements. I need to know what I'm up against before I am to appear in court in June. I don't want to spend big $$$ on an attorney, but I also don't want to plead to a lesser charge, get probation and anger management classes and open myself up to a civil suit (she's claiming I split her lip - I don't know). Can I get the report w/o an atty? What should I do now?

If there has been a criminal case filed, which it certainly sounds like it has since you have to appear in court, the District Attorney's office is now in charge of the case and you need to contact them for the reports. Call the DA's office for whatever jurisdiction you are in and tell them you want to order the discovery in your case. As the defendant you are entitled to everything they have against you. You will be charged, but it generally is only a couple of dollars.

You can get the complete report by requesting discovery in you case. Pay attention to the back of the ticket. That's where the cop or deputy would write about their impressions of the contact. Disco will cost less than $20 (less than $10 even). The request is made through the DA's office.
