Legal Question in Criminal Law in Colorado

Oklahoma felon with poessession charge in Colorado.

I am currently in the fourth year of a seven year suspended sentence in the state of Oklahoma. I was recently pulled over in Colorado and charged with a possession of marijuana and issued a ticket citation for psossession of less than one ounce of marijuana. How will this affect my suspended sentence? Does the fact that it happened in a different state matter? Also will the Oklahoma authorities know about a misdemeanor violation in another state? If I am convicted of the possession charge will I have to serve my full 7 years?

Re: Oklahoma felon with poessession charge in Colorado.

If Oklahoma finds out, you will likely be regressed or in some way punished. It depends on the language of your agreement with that court, but every one that I have seen says "commit no violations of law."

The different state issue would not matter in Colorado, so I assume OK is the same.

You might be given a short sentence of a few weeks or months, rather than the full time, but you are eligible for the full time.

You might be able to fight the charge in Colorado. Why were you stopped? Why were you searched? Did you admit the drugs were yours? Did they give you miranda warnings? Where were the drugs found? What kind of plea offer has been made?
