Legal Question in Criminal Law in Colorado
Pending Cases
If someone had 3 criminal cases that he was sentenced to a drug program for instead of doing state time (12-16 yrs)and the program was not completed, when that person is back in custody if the judge gives a bond on the old cases, does this open these cases back up?

Usually not completing the drug treatment program violates probation. The Judge then has an opportunity to re-sentence the person on the original three cases. The cases haven't been reopened if a guilty plea has been entered. Sentencing is reopened and the defendant is subject to the possible sentence when he originally entered the not guilty plea.
