The felon must make sure that at no time he or she is able to "have possession" of the gun. Possession is defined lossely to include being able to have access to the gun or is within his or her lungeable reach. The person owning the gun must also so make sure otherwise the felon can be charged and possibly convicted of psssession of a weapon by a previous offender. It may be wise for the non felon not to possess a weapon in order to avoid this sticky problem. The legal definition of "possession" is differrent from what a lay person would consider possession.
