Is a petty offense ( less than one ounce) of Marijuana considered a criminal offense?

Yes, but as the name implies, it is a minor criminal offense. Possession of no more than one ounce of marijuana is a Class 2 petty offense with a maximum $100 fine, and no jeopardy of possible jail time.
A Class 1 petty offense can net six months in jail.
