Legal Question in Criminal Law in Colorado
Can police go into a hospital room?
My husand was in a car accident, and had closed head trauma. He's been in a coma for 5 weeks, and is now beginning to wake up. He can speak, but makes very little sense. The police think he was driving. Now that he is out of his coma, can the police go into his hospital room and question him? He won't know to ask for a lawyer since he is just waking up, and is very confused.

Re: Can police go into a hospital room?
The police can go to his room, so you have to make it very clear to them you do not want him talking and he is invoking his right not to talk. The best way to do this is to immediately hire an attorney and have them contact the police and tell them that your husband is invoking his right to remain silent and they are not to go to speak to him. Good luck.
