Legal Question in Criminal Law in Colorado

Poor Service from a Public Defender

Both me and my husband have called his Public Defender for over a month and he has still not returned our messages. I even called his 'supervisor' twice and nothing. What would be our next step to get a response or request to change his Public Defender?

He has the right to an appointed attorney. He does not have the right to a specific attoreny. His next step would be to contact the court clerk and request a Marsden hearing.

You WILL get a response if the court holds a conflict hearing. The Public Defender will appear at the hearing. Even if you do not get a new attorney (which you will likely not get), you can speak directly at/to the Public Defender when you see the Public Defender at the hearing.
