Legal Question in Criminal Law in Colorado

probation violation / felony

My sister was on a deferred sentence (on probation) for a felony theft charge (she opened a credit card in her friends name and charged it up). My sister was recently caught with a small amount of marijuana and paraphernalia and, to escape being arrested, presented the officer with MY driver's license, pretended to be me, and forged my name on the ticket. I found out about this from my new employer as it appeared on my background check.

My sister is now at risk of being charged with lying to a police officer and forgery and I'm afraid that she will be convicted. She is only 21-years-old, is very bright and has a lot of potential. I truly believe she has just been down a bad path for a few years and wants to be a better person. I don't want to see her have a felony record because I know it can ruin a lot of her life.

Do you think there is any chance of her escaping a felony charge? Do you think a lawyer is necessary?

Thanks!!

Re: probation violation / felony

She needs help. Even if she escapes a felony impersonation/fraud charge, the deferred on the felony theft will be revoked. A felony conviction will then enter. Get her a lawyer.
