Legal Question in Criminal Law in Colorado
question
me and my wife are being charged with cultivation. the plants weren't ours and the person that owned the plants confessed and they didn't care and charged us with cultivation. when we confessed to the plants being ours we were high. is there any way we can fight this?

There's a difference between a statement to police ("confession") and a plea of guilty before the court. Your next step depends upon the posture of the case (that is, the stage at which you are involved). The confession can be attacked at trial. The jury should know that the statement to police was given when you were under the influence of thc. If you already pleaded, you need to attack the plea and the circumstances under which it was given. Get help soon. Very soon.
