A probation violation hearing does not resemble a trial in many respects. First - the hearing is based on the civil standard of proof - by a preponderance of the evidence. Second - there is no right to a jury and the rules of evidence allow for such things as hearsay to be used to prove the violation. Finally - the decision is often swift with little time to call witnesses and take other measures that are commonly used by criminal defense lawyers in criminal trials.. good luck. HMS
