Legal Question in Criminal Law in Colorado
requesting jury trial
My sister was charged with a crime she went to court and requested a jury trial, she was told there would be a fee she has a low income so she got the necessary papers to have the fee waved and turned them in the same day at the same place where she was. a couple of days ago she got a letter stating that she was denied the jury trial because her paperwork wash not turned in on time, how does she correct this? is she allowed to submit another form or go back to court and explain her situation or does she just lose her jury trial altogether, since it was not her fault but the courts how does she prove this.

Hello:
Many jurisdictions limit the time for requesting a jury trial to within 10 days after the entry of a not guilty plea. Most stricltly enforce this, and once the dealine is missed it cannot be undone. It sounds like your sister may have missed the deadline...
