Should we retain an attorney?
My 16 year old son was arrested at his place of work for felony theft.The place he worked at would take in used video games for store credit.
He used false names to use store credit to purchase games and would retun them and continue using store credits. 3 or 4 other employees also did the same.
When questioned by company loss
prevention he confessed. I was there to pick him up from work when the police were called. He was released in my custody. We were told that we would be contactd by dectectives later for prints and photos. 15 days later while on a school band competion
he was again arrested for the same charge and taken to the police station for processing. A friend of my son's called to tell me what had happened. 5 minutes later I recieved a call form the arresting officer telling me of the arrest. Again being told detectives would contact us about court dates.
Today I recieved a letter from a law office saying that they represent the place of business and if within 20 days we pay $250.00 they will send written release of the civil penalty claim. Does that mean charges will be dropped if we do this? Should we pay this? Do we need to retain an attorney?

Yes. The $250 is a fee which you can fight, but it has nothing to do with the criminal case. If it was my son, I would hire an attorney and fight both cases. The last thing your son needs is a felony conviction on his record, even if he is a juvenile. As I represent both juveniles and adults in criminal cases, I continue to see how detrimental a felony juvenile conviction can be on a person as an adult and how messed up this can get with an attorney that does not understand or practice juvenile law. The civil penalty claim is not connected with the criminal charges. Those charges will not be dropped if you pay the store. Your son is charged with a felony. Of course you need an attorney.
