robbery

my son is being accused of takeing a back pack he is 16yrs and now a detective wants to issue a warrent for his arrest because they are say that he was identidied out of a photo. from the school year book

No matter what your son says or how much he is willing to speak to the police, do not let the police speak to him. He should ask for a lawyer and assert his fifth amendment right to remain silent. The police often take statements out of context or do not record statements correctly. Your son's words could be used against him. Hire a lawyer as soon as possible. Have the lawyer speak to the detective. Many times police say they are going to get a warrant in order to get a person to come in and make a statment. If he is going to get a warrant, there is nothing you can do to stop it from happening. But, do not assist them in their investigation. If a warrant has been issued, you can take your son in to surrender himself to the police on the warrant. A lawyer can assist you with that as well.

Under no circumstances should you allow the poloce to talk to your son and hire an attorney to defend him. Good luck.

The "I'm going to arrest you" line is one to which the police hope a defendant will respond by making a statement. It matters not how great that statement may be. If the police were going to arrest him before, they are still going to arrest him now. The difference is, now they have a statement. DO NOT allow this child to waive his right to silence!! Get a lawyer.
