seal a class 4 misdemeanor theft charge

Hi there,

I was wondering what / if anything / I can do to seal a class 4 misdemeanor theft charge I have from 10 years ago. I am currently applying for a position that mandates fingerprinting and a background check. I have no priors, and nothing since. I paid restitution and completed my 80 hours of community service, so completed all requirements. I was not sentenced to jail time, or parole. Can you help?

You cannot seal a conviction.

In Colorado, you can only seal a case in which you were acquitted at trial, or charges were completely dismissed. There is a way in which you may have pleaded guilty, gotten probation and still had charges dismissed. That would be a deferred sentence. If you had that, you may be able to seal the record. PS- there is no such thing as a class 4 misdemeanor. Theft over $500 would be a class 4 felony. Misdemeanors are class 1, 2, or 3.
