sealing records for misdemenor in 1996

in 1996 I was charged with a

criminal offense misdemeanor for

threatening my mother with a knife.

I have numberous hospitalizations for

mental issues and now at age 36 I

have not had any further charges

against me and the district that I am

trying to seal, will not allow it. i

currently live with my mother and

she cannot come with me to the

hearing because she has to work but

would like the judge to know that

she is in agreement that this be

sealed. I cannot get a job with this

on my record. I therefore have no

income and need legal advice. could

you direct me in any way as to what

I need to do next?

Did you agree to waive FOREVER your write to seal under a deferred? Did you instead get a conviction or a plea w/probation? If not, set a hearing. Have your mom show up (if she really is supporting you, she should be there). If she won't come to court, get a sworn affidavit.

If you were convicted of the charge, unfortunately under current law the record cannot be sealed in Colorado.
