Legal Question in Criminal Law in Colorado
Seeking different counsel in my criminal case
Being that this is my first criminal case ever (and having a clean record) the end of this court matter is a few days away & my attorney has reassured me that i will not win if i choose to go to trial with this case (due to details involved in the case). On the other hand the DA has stood pretty firm on their decision of an F5 as a bargain offer (originally being charged with two F4's). To me that is not a deal. Whether its F4 or F5...a felony is a felony. I have no criminal history whatsoever and i don't feel i deserve nor have been given the full legal aid & guidance to being helped from my attorney. Period. But now my motions hearing is a few days away (well being that i don't take the DA's deal, and i'm not) & how do i proceed to represent myself as proffessional as possible to the judge when trying to explain that i'd like to seek new counsel, right in front of my lawyer as well? Because it's this far in my proceedings will that be a burden to the judges ears when hearing such a request so late that it might have a good possibility of being declined? Basically what are the chances i get that granted? (And taking in mind that i've had 2 continuances already due to delay of discovery, if that has any effect at all).

Did you hire the current lawyer, or is the lawyer paid for by the state (public defender)? If you have new, private counsel, you'll likely be able to get this new, private counsel in if you work fast. If you just want new, free counsel, you will be denied an appointment of new counsel unless you can show a conflict.
