Legal Question in Criminal Law in Colorado

Seeking Restitution for being falsely accused

My ex girlfriend falsely accused me of stalking her and eavsedropping on her when she was the one initiating contact with me. I changed my number and she found it out and initiated contact with me by calling me 7 times and talking to me for an hour. We sent text messages back and forth. She sent me picture messages of herself. Then four hours later when her new boyfriend comes home and I attempt to send her text messages she claims that I was stalking her.

The police came to my house and arrested me without asking questions. I had to miss 2 days of work, paid $2500 for a lawyer, and bond fees.

With the evidence i have (picutres, txt msgs she sent me, call logs, and e-mails from her) can I file criminal charges for perjury? I also want to go to civil court and sue for the expenses incurred.

I went to court once and they reviewed the charges and they dropped it to a misdemeanor harrasement. I have to go to court this week and my lawyer is setting this for trial. Are the police at fault for arresting me like this? Why was I charged with felony charges and then the court found out there was no evidence for them? Do I need to wait for my case to be dropped first before going after her? Can I file criminal charges? Thanks.

With respect, sir, you have a lawyer: why not ask these questions of him or her?
