Legal Question in Criminal Law in Colorado

Shoplifting Accessories?

I am American; my Russian boyfriend's Armenian roommate (rm) borrowed my boyfriend's (bf) car 5/7/03 & shoplifted Blockbuster DVDs. 5/14/03 my bf got note in mail that his car was used in an act of shoplifting on 5/7. When my bf told me of the note I was alarmed, for on 5/1 or 5/2 the rm had me drive him to a place to sell DVDs; I did because he had no car, and I assumed no driver's license-he wanted me to use mine/my name/address to sell them. I got $54, which I gave the rm; he gave me $4 for gas. Now we got note in mail about his car/shoplifting of DVDs elsewhere, I look back at the selling and wonder if I was an accessory to a crime. I don't know what I should/should not tell the police when we lead them to rm later today. I do not wish to incriminate myself. We had no clue rm was doing anything illegal til (5/14/03). I also do not want my bf deported for something his rm did. Please help.

Re: Shoplifting Accessories?

Well, as a part of any crime, there must be criminal intent, so I do not think you are guilty in any way. But - you could be charged. I suggest that you do not discuss the case with the police any more. Your boyfriend is in a different spot because of INS. He needs to refuse to say anything, and just blame it on the attorney that you spoke with. As this is shoplifting, I doubt they will look further than the room mate.

If the police contact you again, I would get a lawyer. If you are not charged, then the cost will be pretty small. The idea of getting a lawyer now is to prevent you from being charged.

Finally, stay away from this room mate. Your bf should also sever ties with him.
